
Attorneys discussed the legal perspectives regarding the family registry and inheritance rights of Kim Min Hee‘s unborn child with director Hong Sang Soo.
On the 24th, SBS Life’s Lawyers of the Round Table (literal title) aired a segment discussing Hong Sang Soo and Kim Min Hee’s situation.
Attorney Yang Na Rae addressed the question of how the family registry would work for a child born between the director and actress: “Since the two are not legally married, if they want the child to be registered under the father, they must go through a paternity acknowledgment process.” She further explained, “Then the child would be registered as the child of the father, Hong Sang Soo. The legal wife’s consent is not required for this.”
Regarding inheritance matters, attorney Lee In Chul stated, “Whether a child is born outside of marriage or within marriage, inheritance rights are the same. While the legal wife and her children may feel wronged, legally, all children have equal inheritance rights.”
Meanwhile, Hong and Kim have maintained their relationship for nine years despite their 22-year age gap, beginning with their collaboration on the 2015 film Right Now, Wrong Then. The director remains legally married after filing for divorce against his wife in November 2016. However, the Seoul Family Court rejected his petition in 2019, and Hong did not appeal the decision.
