Kim Soo Hyun’s agency has warned that they will take legal action against people who spread false information or post defamatory content about the actor.
Gold Medalist released an official statement on October 14th addressing the continued spread of allegations and defamatory content involving Kim Soo Hyun.
The agency noted that the police had previously decided not to refer the allegations against the actor for prosecution due to insufficient evidence. The allegations concerned claims that he had dated the late Kim Sae Ron when she was a minor and had violated the Child Welfare Act.
“Investigators found insufficient grounds to support the allegations after reviewing the evidence,” the agency said.
The agency also pointed to the arrest and indictment of Kim Se Eui, the operator of the YouTube channel HoverLab Inc., who raised allegations against the actor. Kim Se Eui was indicted on charges including defamation through the spread of false information.
Gold Medalist warned that continuing to create or share false content, including reposts of existing posts, videos and comments, could result in legal action, even after the investigation’s findings and the indictment of the person who initially spread the allegations.
The agency specifically cautioned against reposting, editing, or distributing images, photos, video thumbnails and screenshots used in HoverLab’s broadcasts.
“Even if you share an image without adding your own commentary, credit the original source, or simply repost someone else’s content, you may still be held legally responsible,” the agency stated.
Gold Medalist also warned that legal action could be taken against people who use insults, personal attacks, malicious mockery, or defamatory language. This includes indirect forms of defamation that rely on abbreviations, insinuations, or slang rather than making explicit accusations.
The agency said they intends to pursue both criminal charges and civil lawsuits seeking damages against those responsible.
“We will pursue criminal charges without settlement for cases involving serious misconduct. Depending on the court’s rulings, we will also file separate civil lawsuits to seek compensation for business-related damages,” the agency said.
Gold Medalist also called on people who have created or shared the content in question to delete their posts immediately.
However, the agency stressed that deleting a post would not erase legal responsibility for the original act. Whether someone voluntarily removes the content could be taken into account when determining criminal penalties or calculating damages, but deletion would not eliminate potential criminal or civil liability.
The agency added that it is continuing to collect and preserve evidence and will take legal action against confirmed offenders in stages.
Kim Soo Hyun has faced legal disputes since allegations surfaced last year that he had dated the late Kim Sae Ron when she was a minor. The actor has consistently denied dating her during that period.
In July, police decided not to refer Kim Soo Hyun for prosecution over the alleged Child Welfare Act violation, citing insufficient evidence.
Meanwhile, Kim Se Eui, the operator of HoverLab, was arrested and indicted in June on charges including defamation under South Korea’s Act on Information and Communications Network Utilization and Information Protection.
