Chen, Baekhyun and Xiumin Lose All SM Lawsuits: EXO Gears Up for Six-Member Comeback

EXO-CBX, the EXO subunit composed of Chen, Baekhyun and Xiumin, has reportedly lost all ongoing lawsuits against SM Entertainment.

According to Law Times Korea on October 28th, the trio lost their case against SM, which claimed the company had failed to provide full accounting data and imposed unfair contract terms.

Previously, CBX filed a lawsuit with the Seoul Eastern District Court, demanding that SM disclose all settlement records from EXO’s 13 years of activity. However, the court only ordered the company to submit materials related to their new exclusive contract, dismissing all other requests, including the motion to access and copy accounting ledgers.

The members appealed and re-appealed the decision, but both were denied.

In addition, complaints filed with the Ministry of Culture, Sports and Tourism and the Fair Trade Commission were both dismissed without charges. The ministry determined that SM had regularly provided settlement data to the members, finding no violations of exclusive contract laws or cultural industry regulations. The Fair Trade Commission likewise rejected CBX’s claims that SM and Kakao Entertainment had engaged in unfair contracts or provided improper support regarding music distribution fees.

Meanwhile, SM Entertainment recently confirmed EXO’s upcoming year-end fan meeting and new album comeback, announcing that the group will promote as a six-member lineup—Suho, Chanyeol, D.O., Kai, Sehun, and Lay—excluding CBX.
